This Cookie Policy explains how HireClarity, Inc. ("HireClarity", "we", "us", or "our") uses cookies and similar tracking technologies on our website and platform (collectively, the "Services"). By using the Services, you consent to the use of cookies as described in this policy, except where your consent is expressly required for non-essential cookies.

This policy is designed to comply with applicable laws, including the ePrivacy Directive, the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other relevant privacy regulations.

2. What Are Cookies?

Cookies are small text files that are placed on your computer, tablet, mobile device, or other device when you visit a website. They are widely used to make websites work more efficiently, as well as to provide information to the website owners. Cookies can be "persistent" (stored on your device until they expire or are deleted) or "session" cookies (deleted when you close your browser).

In addition to cookies, we use other similar technologies, including:

• Local Storage: Stores data in your browser that persists across sessions. • Session Storage: Stores data temporarily during a single browser session. • Web Beacons/Pixel Tags: Tiny graphic images used to track user activity and site usage. • Device Fingerprinting: Collects information about your device configuration to help distinguish devices.

3. Types of Cookies We Use

We categorize the cookies and tracking technologies used on our Services as follows:

A. Strictly Necessary Cookies (Always Active) These cookies are essential for the Services to function properly. They enable core features such as user authentication, account access, security measures, and session management. Without these cookies, the Services cannot be provided. These cookies do not require your consent under applicable law.

Examples: • Authentication tokens to maintain your login session. • Security cookies to detect malicious activity and prevent fraud. • Load-balancing cookies to distribute traffic across our servers.

B. Functional Cookies (Require Consent) These cookies enable enhanced functionality and personalization, such as remembering your preferences, language settings, and display choices. They may be set by us or by third-party providers whose services we have integrated.

Examples: • Preference cookies to remember your dashboard layout or notification settings. • Language cookies to store your selected language.

C. Analytics and Performance Cookies (Require Consent) These cookies help us understand how visitors interact with our Services by collecting and reporting information anonymously. They allow us to measure and improve site performance and user experience.

Examples: • Google Analytics cookies to analyze traffic patterns and page engagement. • Mixpanel cookies to track feature usage and platform interactions. • Performance monitoring cookies to identify slow-loading pages or errors.

D. Advertising and Marketing Cookies (Require Consent) These cookies are used to deliver relevant advertisements and measure the effectiveness of our marketing campaigns. They track your browsing habits and may be used to build a profile of your interests.

Examples: • Retargeting cookies to show you HireClarity advertisements on third-party sites. • Conversion tracking cookies to measure the effectiveness of our marketing spend.

Note: We do not use advertising cookies to track Candidates who are applying for jobs through a Tenant's use of the Services, unless the Tenant has explicitly configured such tracking and provided appropriate notice to Candidates.

4. Tenant and Candidate Cookies

A. Tenant-Configured Cookies and Tracking Our platform allows Tenants to integrate their own analytics, advertising, and tracking tools (e.g., custom tracking pixels, third-party recruitment software). When a Tenant enables such integrations, the Tenant's cookies and tracking technologies may be activated within the Services. HireClarity does not control these cookies.

By using the platform's integration features, Tenants represent and warrant that: • They have obtained all necessary consents from Candidates and other end users. • They have provided appropriate privacy notices regarding the use of such tracking technologies. • Their use complies with all applicable laws, including data protection and cookie consent requirements.

B. Candidate Data and Cookies Candidates who access the Services to complete video interviews should be aware that: • Essential cookies are used to enable the interview recording and submission process. • Non-essential cookies are only used with the Tenant's configuration and subject to the Tenant's privacy practices. • HireClarity itself does not use cookies to build advertising profiles of Candidates.

If you are a Candidate and have questions about cookies used during your interview process, please contact the organization (Tenant) that invited you to interview.

5. Third-Party Cookies and Service Providers

We use services from trusted third-party providers that may set cookies on your device. These providers are contractually bound to process data in accordance with applicable law and our instructions. The following categories of third-party services may use cookies:

• Cloud Hosting and CDN Providers: For delivering content efficiently and securely. • Analytics Providers: To help us understand usage patterns (e.g., Google Analytics, Mixpanel). • Customer Support Tools: To enable live chat and help center functionality. • Payment Processors: To process billing and subscription payments securely. • Marketing and Email Platforms: To deliver and measure the effectiveness of communications.

We do not sell cookie-derived data to third parties. We do not allow third parties to use cookies on our Services for their own independent purposes, except where required for the service they provide to us.

7. Data Linked to Cookies

Cookies may be associated with the following types of data:

• Account identifiers: To maintain your login session and associate activity with your Tenant account. • Device information: Browser type, operating system, screen resolution, and device identifiers. • Usage data: Pages visited, features used, clicks, session duration, and navigation paths. • IP address and location data: Approximate geographic location derived from your IP address.

Where analytics or marketing cookies collect personal data, such data is processed in accordance with our Privacy Policy. We do not use cookies to collect Candidate video recordings, resumes, or other interview content for analytics or advertising purposes.

8. Cookie Retention Periods

The lifespan of cookies varies depending on their purpose:

• Session cookies: Deleted when you close your browser. • Authentication cookies: Typically expire after a defined session period or when you log out. • Preference cookies: May persist for up to 12 months to remember your settings. • Analytics cookies: Typically expire after 2 years or less, depending on the provider. • Marketing cookies: Typically expire after 90 days to 1 year, depending on the campaign.

We periodically review our cookie usage and remove cookies that are no longer necessary. You can delete cookies at any time through your browser settings.

9. Security of Cookie Data

We implement appropriate technical and organizational measures to protect data collected through cookies:

• Authentication cookies are encrypted and transmitted over TLS 1.2 or higher. • We use HttpOnly flags on sensitive cookies where supported, to prevent client-side script access. • We use Secure flags to ensure cookies are only transmitted over encrypted connections. • We use SameSite attributes where appropriate to mitigate cross-site request forgery (CSRF) risks. • We regularly audit our cookie usage to identify and remove unnecessary or insecure cookies.

Despite these measures, no internet transmission is completely secure. We encourage users to keep their browsers updated and to use reputable security software.

10. International Data Transfers via Cookies

Some of our third-party service providers are located outside your country of residence, including in the United States. When cookies set by these providers collect or process personal data, such data may be transferred to and processed in jurisdictions with different data protection standards.

For transfers from the European Economic Area (EEA), United Kingdom, or Switzerland, we rely on appropriate safeguards such as Standard Contractual Clauses (SCCs), adequacy decisions, or other legally recognized transfer mechanisms. We may update this Cookie Policy from time to time to reflect changes in the cookies we use, changes in technology, or changes in applicable law. When we make material changes, we will:

• Update the "Last Updated" date at the top of this policy. • Notify Tenants via email or through the platform. • Display a revised cookie consent banner to new and returning visitors.

Your continued use of the Services after the effective date of the revised policy constitutes acceptance of the changes. We encourage you to review this policy periodically.
